Terms and Conditions

1. The rights of ownership and operation for the Member Service Agreement ("Agreement") owes to Airport Information Management Solutions Ltd ("AIMS"). Please read carefully the terms and conditions of this Agreement before proceeding. By becoming a member of the website www.macau-airport.com (“Site”), the User agree that he/she has read, understood, and agreed with the following “Terms and Conditions”, and irrevocable consent to be bound by all said “Terms and Conditions”, including any updates thereto. AIMS, as Operator of the site, has the right to change the Terms and Conditions, in whole or in part, at any time with or without notice. If the User does not agree to the Terms and Conditions, he/she can cancel his/her membership and cease use of the Site immediately.

2. Member's Eligibility

The User must be 18 years old or above to register as a member of the Site.

3. Member's Responsibility

(i) The User cannot authorize any other persons to use this Member Account.

(ii) The User must provide true, complete and accurate personal information where required. The User must update personal information when changed. If the information provided by the User is false, inaccurate, outdated or incomplete, AIMS has the right to suspend or terminate the User account. AIMS will not be responsible for any costs associated directly or indirectly with the suspension or termination of the Member account.

(iii) The User agrees to indemnify and hold AIMS and its affiliates harmless from any liability, damage or loss including legal fees and expenses that AIMS incurs or suffers as a result of any action, inaction or omission by the User.

(iv) The User will safeguard his/her account information and password, and is completely responsible for any use of the account. The User agrees not to disclose the account information and password to third parties, and will not use another person’s Macau International Airport Website Member account. If the User discovers the misuse of his/her account by anyone, the User should report the issue to AIMS immediately so that AIMS can suspend the account. The User agrees that AIMS will not be responsible for losses caused by the misuse.

(v)The User understands and agrees to receive information regarding his/her purchase(s), account update and notices sent by AIMS to the email address (es) provided by the User. The User agrees to receive information regarding promotions and offers from AIMS unless he/she opts out of direct mail advertising.

4. Privacy

AIMS will not disclose or publish the User's information unless:

(i) The User requires or authorizes AIMS to disclose the information.

(ii) Verifies the User information with third-Party data for marketing studies or any other lawful use.

(iii) Relevant legal requirements and procedures require AIMS to provide the User's personal information.

(iv) The User confirms that he/she has read the Website’s Privacy Policy, which is an integral and complementary part of this agreement.

5. Copyright and Trademark

The Site contains copyright material, trade names and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound. The entire contents of the Site are protected by copyright law. AIMS owns copyright and/or database right in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it.

The User may not modify, publish, transmit, participate in the transfer or sale of, create derivative works, or in any way exploit, any of the content, in whole or in part.

6. Disclaimer of Warranties

All content, including software, products, services, information, text and related graphics contained within or available through the Site are provided to users on an "as is," "as available" basis. AIMS makes no representations or warranties of any kind, either express or implied, as to the operation of this website or the information, content or materials included on this website and to the fullest extent permissible pursuant to applicable law, AIMS disclaims all representations, conditions and warranties of any kind, either express or implied, including, but not limited to, the implied conditions or warranties of merchantability or satisfactory workmanlike effort, informational content, title, or non-infringement of the rights of third parties. AIMS does not warrant or make any representations that the Site will operate error-free or uninterrupted, that defects will be corrected, or that the Site and/or its servers will be free of viruses and/or other harmful components. AIMS does not warrant or make any representations regarding suitability, availability, accuracy, reliability, completeness, or timeliness of any material of any kind contained within the Site for any purpose, including software, products, services, information, text and related graphics content.

AIMS is not responsible for any failures caused by server errors, misdirected or redirected transmissions, failed internet connections, interruptions in the transmission or receipt of reservations or, any computer virus or other technical defect, whether human or technical in nature.

7. Limitation of Liability

In no event shall AIMS, including its respective employees, affiliates and/or suppliers (collectively the "Covered Parties"), be liable to any person or entity whatsoever for any direct, indirect, incidental, special, exemplary, compensatory, consequential, or punitive damages or any damages or losses whatsoever, including but not limited to (where relevant, caused by):

(i) loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, business interruption, data or other intangible losses;

(ii) the User’s inability to use, unauthorized use of, delay, performance or non-performance of the site;

(iii) unauthorized access to or tampering with the User's personal information or transmissions;

(iv) the provision or failure to provide any service, including services rendered or products offered by the product and/or service providers, (partial) cancellations or overbookings;

(v) errors or inaccuracies contained on the Site or any information (including but not limited to the (descriptive) information (including rates, availability and ratings) of the product and/or service providers as made available on the Site), software, products, services, and related graphics obtained through the Site;

(vi) any transactions entered into through the Site;

(vii) any property damage including damage to the User's computer or computer system caused by viruses or other harmful components, during or on account of access to or use of the Site or any site to which it provides hyperlinks; or

(viii) damages otherwise arising out of the use of the Site, any use, delay or inability to use the Site, or any information, products, or services obtained through the site; or

(ix) any (personal) injury, death, property damage, or other damages attributable to the product and/or service providers

(x) any damages caused by a force majeure event. The limitations of liability shall apply regardless of the form of action, whether based on contract, tort, negligence, strict liability or otherwise, even if a covered party has been advised of the possibility of damages. A force majeure event is an event beyond the Covered Parties’ control and can include, but is not limited to, natural disasters, weather conditions, fire, nuclear incident, electro-magnetic pulse, terrorist act, riots, war, arson attacks, insurgency, rebellion, armed hostilities of any kind, labor disputes, lockouts, strikes, shortages, government actions or restraints, pilferage, bankruptcy, machinery breakdown, quarantine, communications breakdown, epidemic, pandemic etc. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority.

AIMS is not the supplier of the products and services and will not accept any liability in relation to the quality of the products and services of the suppliers.

8. Miscellaneous

Any opinion, view or idea expressed in the Site by the User is the author's own and does not reflect the views of AIMS or its affiliated entities.

This Agreement shall be governed by and construed in accordance with the laws of Macao Special Administrative Region, without reference to its conflicts of law provisions. Any dispute arising out of the Agreement and our services shall exclusively be submitted to the competent courts in Macau Special Administrative Region.

This Agreement is written in Chinese language and may be translated into other languages. In the event of any inconsistency between the Chinese version and the translated version of this Agreement, the Chinese version shall prevail. In case of any dispute, the decision of the AIMS shall be final and conclusive.
